General Terms and Conditions & Indemnity
Mills Peak Adventure Paragliding Association, through BookMyParagliding.com, offers tandem paragliding flight services / Courses / Activities Experiences operated by experienced, state-licensed tandem pilots with extensive knowledge of the local terrain, weather patterns, and micro-climatic conditions of the mountains, ridges, and valleys.
Each tandem pilot conducting a flight acts as an independent, legally responsible contractual partner for the transportation of the passenger to the take-off site and for the execution of the tandem paragliding flight. All operational responsibility, liability, and services performed during the flight rest solely with the licensed tandem pilot assigned to the booking.
Passenger Declaration & Participation
The tandem passenger declares that participation in a tandem paragliding flight is entirely voluntary and based on personal interest. The execution, route, duration, and nature of the flight are determined solely by the pilot, depending on prevailing weather and safety conditions.
Prior to take-off, the passenger (or, in the case of a minor, a legal guardian or accompanying adult) must carefully read and accept the indemnity and safety declaration provided before the flight.
Pre-Flight Briefing & Instructions
Immediately before take-off, the pilot will provide detailed instructions regarding the take-off, flight, and landing procedures. These instructions may be delivered in person or via a pre-recorded briefing video available on the website.
If the passenger does not understand any instruction or feels unable to follow them for any reason, they must inform the pilot immediately and request clarification. Failure to follow instructions may compromise safety.
Flight Duration & Operational Changes
Flight duration varies depending on weather conditions, thermal activity, and the selected flight type. As such, standardized flight times cannot be guaranteed.
The pilot reserves the right to modify the flight route, duration, or landing location at any time for safety or operational reasons. The passenger shall not be entitled to compensation, refunds, or claims arising from such changes.
Passenger Conduct & Safety
The passenger must follow the pilot’s instructions at all times. A theoretical introduction is provided before flight. Failure to comply with instructions during take-off, flight, or landing may endanger both pilot and passenger.
Despite all reasonable precautions, paragliding is an adventure sport and carries inherent risks. Our priority is to minimize risk, but accidents may still occur.
The pilot may refuse to conduct or continue a flight if the passenger ignores instructions or behaves unsafely. In such cases, the passenger forfeits any right to flight completion or refund. Liability for injuries resulting from non-compliance rests solely with the passenger.
Any intentional or grossly negligent damage to pilot equipment or third-party property shall be borne by the passenger.
Physical Assistance & Harness Adjustment
The pilot may adjust the passenger’s seating position and harness to ensure safety. Such physical assistance is strictly professional and safety-related and should not be considered inappropriate. This process is explained during the safety briefing.
Health Declaration
The passenger confirms that they are physically and mentally fit to undertake a tandem paragliding flight. Any uncertainty regarding fitness must be disclosed to the pilot before the flight.
The pilot must be informed prior to the flight in case of:
- Restricted mobility or physical limitations
- Heart, back, or blood pressure conditions
- Susceptibility to motion sickness
- Mental health conditions, substance dependency, or impaired consciousness within the past 12 months
- Consumption of alcohol or strong medication within the previous 12 hours
Failure to disclose such conditions may result in denial of flight without refund.
Equipment & Clothing
Passengers must wear suitable clothing appropriate for outdoor flying conditions, including weather- and wind-resistant attire that may get dirty, ankle-high sturdy footwear, gloves, and sunglasses.
All necessary flight equipment, including helmets and safety gear, will be provided by Mills Peak Adventure Paragliding Association through its licensed pilots.
Insurance & Personal Belongings
To comply with state liability regulations, an optional insurance policy is held through a third-party insurance provider. All insurance claims are subject to the terms of the insurance provider, and Mills Peak Adventure Paragliding Association disclaims direct liability for such claims.
Passengers are responsible for securing personal items such as money, mobile phones, cameras, glasses, and valuables before departure. No liability is accepted for loss or damage to personal belongings.
Pilots are not responsible for accidents or damages occurring during transportation to or from take-off sites or meeting points.
Limitation of Liability
Liability exclusions or limitations apply equally to employees, independent pilots, and representatives of Mills Peak Adventure Paragliding Association.
Pilot liability is limited to cases involving proven gross negligence or intentional misconduct. Carrier liability for personal items is limited to the maximum coverage provided under the applicable insurance policy.
Use of Photo & Video Material
The passenger agrees that all photographs and video recordings captured during the tandem flight may be used by Mills Peak Adventure Paragliding Association for marketing, promotional, and commercial purposes without limitation. Copyright of such material remains with the Association.
Cancellations & Weather Conditions
Even with a confirmed flight time, the passenger has no right to demand completion of a specific flight duration if weather conditions require early landing or cancellation for safety reasons.
Delays in take-off do not entitle the passenger to claims, refunds, or compensation. Cancellations due to weather conditions are based solely on the pilot’s professional judgment, which is final.
Final Clauses
If any provision of these Terms & Conditions is deemed invalid or unenforceable, the remaining provisions shall remain fully valid. The invalid provision shall be replaced with one that most closely reflects the original intent.
By making payment, purchasing a flight ticket, or verbally agreeing to a transportation order, the passenger enters into an air carrier contract with the assigned tandem pilot through BookMyParagliding.com.
This contract is governed by the laws of India, with jurisdiction and place of fulfillment in Himachal Pradesh.
